1. Agreement to Terms

By accessing or using TallyFlow at tallyflow.gabrieleserpi.com ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

TallyFlow provides a professional tally light system for live video productions. The Service allows users to send tally signals (Program/Preview indicators) to camera operators via web-based interfaces on their mobile devices.

3. Account Registration

To use the Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be at least 18 years of age
• Accept responsibility for all activities under your account

You must notify us immediately of any unauthorized use of your account.

4. Subscription and Payment

4.1 Free Trial

New users receive a 3-day free trial with full access to all features. No credit card is required for the trial.

4.2 Paid Subscriptions

After the trial, continued use requires a paid subscription. Available plans:

• Monthly: €30/month
• Quarterly: €75/3 months
• Yearly: €250/year

4.3 Billing

Payments are processed securely through Stripe. Subscriptions automatically renew unless cancelled before the renewal date. You can cancel at any time from your dashboard.

4.4 Refunds

Due to the digital nature of the Service, refunds are generally not provided. However, we may consider refund requests on a case-by-case basis within 7 days of purchase.

5. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Share your account credentials with others
• Resell or redistribute the Service without permission
• Use the Service to transmit malicious content

6. Intellectual Property

The Service, including its design, features, and content, is owned by Gabriele Serpi and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without written permission.

7. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or technical issues. We are not liable for any losses resulting from service interruptions.

8. Limitation of Liability

To the maximum extent permitted by law, TallyFlow and Gabriele Serpi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, secure, or meet your specific requirements.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

You may cancel your subscription at any time. Access continues until the end of your current billing period.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of Italy. Any disputes shall be resolved in the courts of Italy. For EU consumers, this does not affect your rights under mandatory consumer protection laws in your country of residence.
